The federal high Court sitting in Gusau Monday has described the case before it challenging defection of Governor Bello Mohammed Matawalle of Zamfara state from PDP to APC in originating summons filed by the plaintiffs as lacks merit.
The presiding judge Justice Baffan Aliyu said the matter before the court is neither post elections matter or pre election therefore the federal High Court lacks jurisdiction to grant the reliefs sought by the plaintiff.
The Court observed that the constitution of the PDP and the Nigeria constitution didn’t any way prohibits any person from joining any association or political party of his own choice.
The court said only elections petition tribunal or state House of Assembly that can remove a governor from his office
Meanwhile the court awarded the cost of 1million naira to each of the dependants to be paid by the plaintiffs as compensation.
Meanwhile, Mr. Mike Ezeokhome, SAN who represented the Gov Bello Matawalle and the APC expressed satisfaction for the ruling by the court in favour of his clients, while Mr. J.C Shaka said the plaintiffs would study the judgement for further action.
