The High Court 2, sitting in Gusau, the Zamfara State Capital has Wednesday dismissed the suit filed before the Court by 14 elected Local Government Council Chairmen under APC during immediate fast administration of former Governor Abdulaziz Yari, challenging the State Assembly, office of the Attorney General of the State and Commissioner of Justice and Zamfara State Government, for untimely dissolution of them which is contrary section 7 that complemented Section 13, 14, 15, 16, 17 and 18 of Zamfara State Local Government Laws 2012 as ammended.
The Preciding Judge, Justice Bello Shinkafi in his final ruling of the case, said the court dismissed it for an abuse of process condemned by the Supreme Court Provision for haven similar suits before different courts in the state.
Addressing journalists shortly after the sitting, the Director Civil Litigation of the state ministry of Justice who represented the state government and Attorney General of the state also the Commissioner of Justice, Barrister Surajo Abdullahi and his assistant, Barrister Bello Aliyu said, the dismissal of the case was as a result of haven the samilar suits before different court of law challenging the State Assembly, Attorney General of the state also the Commissioner of Justice and Zamfara State Government for what they attributed, illegal dissolving while their tenure hasn’t been expired.
Barrister Surajo Abdullahi further explained that, the motive behind their dissolution by the state government was as a result of their refusal to complement the Security and Zamfara State Government efforts on insecurity issues which was bedivilled the state for almost a decade to Cattle Rustlers, Kidnappers, Armed Bandits and other criminality henoise activities that led to the killings, maiming, destructions of innocent lives, properties and villages in the state.
Also speaking to Newsmen shortly after the judgement, the Councel to the APC Local Government Council Chairmen, Barrister Surajo Garba, admitted their mistake for filling similar case to different court in the state as challenged by the High Court 2 which led to the dismissal of their case, saying they will look for another alternative to seek redress.
It could be recalled that, Zamfara State Government under the leadership of of Goveronor Bello Mohammed Matawalle, on the 4/5/2020 has dissolved all the 14 local Government Council Chairmen elected under the platform of All Progressive Congress APC, during the immediate past administration of former Governor Abdulaziz Yari Abubakar and appointed the caretaker committee Chairmen.
